The second of two public hearings will be held at the meeting of the Decatur City Council on Monday, July 28, 2008, at 6:00 p.m. at the City Hall Council Chamber located at 201 E. Walnut to consider Hersh Development’s petition to annex approximately 10.3 acres of land and 0.755 acres of S. Murvil Street in to the corporate limits of the City of Decatur, Texas. The property to be annexed is generally located south of Preskitt Road, east of Fairview Court and west of S. Murvil Street in Decatur’s southwestern Extraterritorial Jurisdiction (ETJ).

Monday, 07/14/08City Council conducts first public hearing.
• Public notice must be no less than 10 days and no more than 20 days before public hearing.
- Annexation Study prepared and available for public review.
- Service Plan prepared and available for public review.

Monday, 07/28/08

City Council conducts second public hearing.
• Public notice must be no less than 10 days and no more than 20 days before public hearing.

Tuesday, 08/05/08

Planning and Zoning Commission public hearings – make a recommendation to City Council regarding the proposed annexation and the proposed zoning.

Monday, 08/18/08

City Council by a four-fifths vote institutes annexation proceedings by conducting First reading of annexation ordinance. (Special Called Meeting)
• Action must be more than 20 days after the second public hearing but less than 40 days from the first public hearing.

Monday, 08/25/08

City Council by a four-fifths vote takes final action. Second reading and adoption of the annexation ordinance. City Council considers approval of zoning request.
• Council action must be more than 30 days after publication of ordinance (if publication is required) and less than 90 days after council institutes annexation proceedings (adopts ordinance on 1st reading).
CC Public Hearing and First reading of zoning ordinance.

Monday, 09/08/08

Second reading and adoption of zoning ordinance.

Annexations must be rigidly coordinated in conjunction with the City Council public hearing schedule due to specific timing mandates established by Texas State Law. The Texas Local Government Code requires that City Council institute annexation proceedings (1st Reading of the Ordinance) more than 20 days after the second City Council public hearing but less than 40 days from the first City Council public hearing.
